Welcome to Racing Pigeon Auctions (“we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website https://rpauctions.com (“Site”) and services. By registering, bidding, buying, or selling on our platform, you agree to follow these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old to use our Site. By registering, you confirm that the information you provide is accurate and that you agree to comply with all applicable laws.

2. Accounts and Registration

To bid or sell on our platform, you must create an account. You’re responsible for keeping your login details secure. Do not share your account or impersonate others.

We reserve the right to approve, suspend, or delete accounts that violate our rules or appear fraudulent.

3. Auctions and Bidding

All bids are binding. When you place a bid and win, you are legally obligated to complete the purchase.

Shill bidding (bidding to artificially increase the price) is strictly prohibited.

We reserve the right to cancel or suspend any auction at our discretion for fraud, abuse, or technical issues.

Reserve prices may apply. If the reserve isn’t met, the item will not be sold.

4. Fees and Payments

We charge a 9% success fee from sellers when a bird is sold.

Payments are processed securely through trusted third-party services. We do not store full credit card details.

5. Seller Responsibilities

Sellers must only list birds they own and must provide honest, accurate descriptions and photos.

Sellers are expected to ship birds promptly after payment is confirmed.

Misrepresentation, failure to ship, or unethical behavior will lead to account suspension or legal action.

6. Shipping & Risk

Buyers and sellers are expected to coordinate shipping after the auction closes. Seller should reach out to buyer within 24 hours of auction close.

Shipping is at the buyer’s expense. Risk of loss or injury to the bird during transit lies with the buyer once the bird is shipped.

7. Refunds & Disputes

RPAuctions does not issue refunds under any circumstances. All transactions conducted through our platform are strictly between the buyer and the seller. As a third-party service provider, we are not responsible for:

The quality, condition, health, or authenticity of any pigeons or items listed

Misrepresentation or failure to deliver by a seller

Disputes regarding payment, shipping, or timing

Buyer Responsibility

Before placing a bid or making a purchase, buyers are responsible for:

Reviewing all photos, descriptions, and terms provided by the seller

Asking the seller any clarifying questions before bidding

Understanding that all sales are considered final unless otherwise stated by the seller. 

If a buyer wishes to request a refund or resolve a problem with a transaction, they must contact the seller directly. Each seller may have their own refund or return policy, and it is the buyer’s responsibility to review those terms prior to bidding.

RPAuctions is not obligated to mediate disputes and does not guarantee outcomes.

8. Site Use and Restrictions

You agree not to misuse the site, post harmful or false content, or interfere with auctions or accounts.

We reserve the right to suspend or remove any content or user at our discretion.

9. Intellectual Property

All content on this site — including logos, branding, listings, and media — is owned by Racing Pigeon Auctions or its licensors and cannot be copied or used without permission.

10. Limitation of Liability

We do our best to ensure a secure, functional platform, but we are not liable for damages, losses, or interruptions caused by user error, technical issues, or third parties.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the site after updates means you accept the new version. Check this page regularly for changes.

12. User Agreement & Jurisdiction Notice

By accessing or using RPAuctions.com, you acknowledge that you have read, understood, and agreed to be bound by our Terms and Conditions, including our Refund Policy.

You further agree that:

RPAuctions.com is a neutral platform connecting buyers and sellers, and does not guarantee the outcome of any transaction.

All sales are final unless otherwise stated by the individual seller.

Any disputes arising from the use of this site, including buyer-seller disagreements, must first be attempted to be resolved through informal mediation.

All legal matters, claims, or disputes that cannot be resolved informally will be governed by the laws of the State of South Carolina, and mediation or arbitration shall take place exclusively in Horry County, South Carolina.

If you do not agree to these terms, you must not use this website.
